The rules in full

Statewide cap

No cap on amount. Related limits: one rent increase per 12 months of consecutive occupancy (C.R.S. 38-12-702).

Written notice

Residential tenancy with NO written agreement: landlord may increase rent only on at least 60 days' written notice. If a written agreement exists, the agreement governs the increase (not found a statutory minimum for written month-to-month agreements). Also one increase per 12 months. Termination (notice to quit) for month-to-month: 21 days (tenancy 1 month to under 6 months), 28 days (6 months to under 1 year), 91 days (1 year or longer).

Local rent control

No county or municipality may enact an ordinance/resolution controlling rent on private residential property; exceptions for voluntary agreements/deed restrictions tied to permits or affordable housing, and for property the government manages via housing authority. Mirror is C.R.S. 2024, 'current through Fall 2025'. Some secondary sites wrongly say preemption was repealed (2021); not supported by statute text. 2026 session changes not confirmed.
