The rules in full

Statewide cap

No statewide cap; no statute regulates rent amount.

Written notice

No rent-increase notice statute. Default for month-to-month: either party terminates by notice; tenancy ends on the later of the date in the notice or one month after notice (rent period >= 1 month). Parties may agree in a signed instrument on a different notice period or none (91.001(e)).

Local rent control

Municipality may establish rent control only if governing body finds a housing emergency due to a disaster (Gov't Code 418.004) AND the governor approves the ordinance; must continue/discontinue with the disaster declaration. Effectively near-total bar. Text from public.law mirror (snapshot May 2025). 2025 HB 3340 (89R) would add rent control for persons 65+; introduced only, passage not confirmed (assume not enacted).
